These terms govern your use of Ark Gravity's platform and services. Please read them carefully.

Section 01

Agreement to Terms

By accessing or using the website at arkgravity.com and any services provided by Ark Gravity, operated by bshko LLC("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service.

If you do not agree to these terms, do not use our services. Continued use constitutes acceptance.
Section 02

Services

Ark Gravity provides digital infrastructure services for service businesses, including but not limited to:

  • Website design, development, and hosting
  • CRM configuration and management — powered by GoHighLevel
  • Marketing automation and lead generation systems
  • AI-powered business tools and integrations
  • Ongoing system management and optimization

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

Section 03

Client Accounts

When you engage our services, you may be provided access to platforms and tools configured on your behalf. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and current business information
Section 04

Payment Terms

Service fees are outlined in your individual Scope of Work or service agreement. Unless otherwise specified:

Setup feesDue upon project initiation
Monthly retainersBilled on the 1st of each month
Invoice termsNet 15 days from issue
Late fee1.5% per month on outstanding balances
We reserve the right to suspend services for accounts overdue by more than 30 days.
Section 05

Intellectual Property

Our Property

All proprietary systems, templates, automations, workflows, and methodologies developed by Ark Gravity remain our intellectual property. This includes our system architecture, GoHighLevel snapshots, and automation frameworks.

Your Property

You retain ownership of your business data, brand assets, content, and any materials you provide to us. Custom work product created specifically for your business becomes your property upon full payment.

License

During the term of service, we grant you a non-exclusive, non-transferable license to use our systems as configured for your business. This license terminates when your service agreement ends.

Section 06

Third-Party Services

Our infrastructure may integrate with or rely on third-party services, including but not limited to GoHighLevel, Google Workspace, Stripe, and various AI providers.

We are not responsible for the terms, policies, or availability of third-party services. Your use of these services is subject to their respective terms.
Section 07

Data & Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection, use, and processing of data as described therein.

Section 08

Marketing Communications & Newsletter

By subscribing to our newsletter or opting into marketing communications, you expressly consent to receive emails from Ark Gravity including:

  • Industry insights and growth strategies
  • Product updates and system announcements
  • Promotional offers and new service launches

You may unsubscribe at any time by:

  • Clicking the "unsubscribe" link in every marketing email
  • Emailing ops@arkgravity.com with "Unsubscribe" in the subject
We process unsubscribe requests within 10 business days per the CAN-SPAM Act. Transactional emails (invoices, security alerts, service updates) will continue regardless of your marketing preferences. We never sell, rent, or share your email address with third parties.
Section 09

Acceptable Use

You agree not to use our services to:

  • Violate any applicable law or regulation
  • Send spam, unsolicited communications, or misleading content
  • Distribute malware or engage in phishing
  • Infringe on any third party’s intellectual property rights
  • Interfere with or compromise the integrity of our systems
  • Resell or redistribute our services without authorization
Section 10

Limitation of Liability

To the maximum extent permitted by law, Ark Gravity and bshko LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.

Liability cap: Our total liability for any claim shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
Section 11

Disclaimer of Warranties

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the reliability, availability, or fitness for a particular purpose of our services.

While we strive to deliver measurable results, we do not guarantee specific business outcomes such as revenue increases, lead volumes, or conversion rates.
Section 12

Termination

Either party may terminate the service agreement with 30 days' written notice. Upon termination:

We reserve the right to terminate services immediately for violations of these terms or non-payment exceeding 60 days.

Section 13

Indemnification

You agree to indemnify and hold harmless Ark Gravity, bshko LLC, and their officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any third party's rights.

Section 14

Governing Law

These terms are governed by the laws of the State of Nevada, without regard to conflict of law provisions.

Any disputes shall be resolved in the courts located in Clark County, Nevada.
Section 15

Changes to Terms

We reserve the right to update these terms at any time. Material changes will be communicated via email or through our platform. Continued use of our services following any changes constitutes acceptance of the updated terms.
